Crimes dans les mondes virtuels

The Register annonçait récemment
que les participants aux mondes virtuels comme Second Life sont devenus
des cibles pour les cybercriminels : 3 usagers sur 10 disent avoir
perdu des items leur appartenant suite à des fraudes. En 2007
seulement, 30 000 nouveaux programmes visant à voler les mots de passe
des usagers des mondes virtuels ont vu le jour. Cette situation est
d’autant plus préoccupante que les propriétés (meubles, maisons, épées,
personnages…) des mondes virtuels ont une valeur marchande dans le
monde réel - une industrie de plus de 3 milliards de dollars canadiens
dans le monde.
Il semble évident que les cybercriminels profitent du
peu de législation et de jurisprudence touchant aux mondes virtuels
pour y commettre des crimes qui leur vaudraient de lourdes peines dans
le monde réel, mais que peut-on faire pour les arrêter ?
Dans un rapport intitulé “Virtual Worlds, Real Money”
(pdf), l’Agence européenne chargée de la sécurité des réseaux et de
l’information (ENISA) y va de plusieurs recommandations. Par exemple,
l’ENISA suggère de financer du travail de recherche en Droit pour
clarifier les implications légales de différents aspects des mondes
virtuels, comme les questions de propriété intellectuelle et de
sécurité des informations des joueurs. L’Agence recommande aussi aux
développeurs de mondes virtuels d’en augmenter la sécurité et de mettre
en place des mesures de détection des fraudes.
Outre ces mesures de prévention, une stratégie efficace
de lutte contre le crime dans les mondes virtuels doit contenir des
mesures coercitives. Aux Pays-Bas, deux
adolescents ont été condamnés à 200 et 160 heures de travaux
communautaires, respectivement, pour avoir volé des items appartenant à
un participant d’un monde virtuel auquel ils participaient. Au Japon, une femme a été emprisonnée après avoir tué son “mari” dans un monde virtuel.
Au Canada, aucun cas
de crime dans des mondes virtuels ne semblerait avoir été porté devant
les tribunaux. Les vols d’items pourraient être considérés comme des
crimes réels en se basant sur le fait qu’ils sont généralement réalisés
à l’aide d’un accès non-autorisé au compte de la victime, ou, à la limite, en considérant que ce sont des vols de propriété intellectuelle.
Par contre, pour les autres types de crimes dans les mondes virtuels,
il existe un flou juridique réel, et il y aurait lieu, ici comme en
Europe, de financer la recherche sur le sujet tel que recommandé par l’ENISA.
